The Department announces the issuance of new Design and Construction Contract documents to be utilized for all Professional Design Contracts effective January 1, 2010, and for all Construction Projects released for bid effective January 1, 2010 

The new version of the Professional Agreement, Instructions to Bidders, General Conditions of the Construction Contract and Administrative Procedures are identified as the “2010 Edition”.

The new documents incorporate new statutory provisions set forth in the Commonwealth Procurement Code while also addressing day-to-day issues that arise throughout the course of any construction project.  The new documents will facilitate the timely delivery of quality designs which will be efficiently awarded to qualified contractors.

A few of the notable changes include:

• A negotiated professional design fee with a clear definition of basic and additional services.
• The elimination of deduct base bids, which will reduce the risk of insufficient project funding.
• Updated instructions and forms for WBE/MBE solicitations and commitments.
• A simplified bid package.
• A new dispute resolution process that encourages on-site discussions and timely resolution of issues in the field.
