Bailey, Brett Alan (Hanover, PA) 6/6/11 Five-year license supervision – Bailey failed to exercise due diligence to determine the validity of AIM Health Plans, which is an unlicensed entity, and subsequently sold coverage to a Pennsylvania consumer. Bailey made restitution for the consumer’s out-of-pocket medical expenses. Nichols agreed to reimburse the consumer’s unpaid medical costs.

Bare, Christopher (Blandon, PA) 9/26/12 Five-year license supervision and $2,000 penalty – In 2009, Bare failed to report a felony arrest. The arrest and subsequent conviction were finally reported in 2012

Baker, Brian P. (Pittsburgh, PA) 3/31/10 License suspension and five-year future license supervision for violating the license supervision terms from his April 28, 2009 Consent Order for failing to report a misdemeanor arrest to the department.

(Exton, PA) 5/26/11 License revocation – Balbirnie failed to pay state income tax since 2005, though he indicated on his renewal application that he was tax compliant; failed to remit funds owed to Nationwide Mutual Insurance Company and pled guilty to several felony charges in 2010.

Balboa Insurance Company (Irvine, CA) 2/18/09 Cease and desist order for not performing due diligence on the oversight of SCA Enterprises Burbank, d/b/a SCA Appraisal. SCA used unlicensed appraisers and/or fictitious people for performing motor vehicle physical damage appraisals on Balboa’s behalf.

Bass Underwriters, Inc. (Plantation, FL) 5/17/10 Five-year license supervision and $25,000 penalty for employing an unlicensed individual who was involved in the sale of over surplus lines polices to PA policyholders.

Bastian, Gary James (Williamsport, PA) 11/9/10 Five-year license supervision and $5,000 penalty – Bastian misrepresented himself as policyholders requesting changes to premium payments and billing formats.

Batipps, Freda J. Norristown, PA 9/13/11 Ten-year license supervision; cooperation with related investigations and $20,000 penalty – Batipps failed to timely obtain valid, signed and dated UM and UIM waiver forms for a policy for agency’s client; accepted falsified and backdated UM and UIM waiver forms, which resulted in an initial denial, claims litigation, and delayed payment of a serious claim. Batipps also failed to report an arrest to the department, but did report the dismissal of the criminal charges.

Batt, Diane (Erie, PA) 5/4/09 License revocation and five-year future license supervision for failing to forward a policyholder’s full automobile insurance premium to a company, but rather, only forwarded half and paid the other half with a personal check. Penalty: License revocation; 5 years future license supervision.

Berglund, Brian J. (Fountain Hills, AZ) and Berglund Enterprises, Inc. (Phoenix, AZ) 3/24/11 License revocation – Berglund improperly retained unearned commissions in Arizona, resulting in a 2009 Consent Order in his home state. Berglund failed to report this action on license renewals for Pennsylvania, Kansas and Delaware.

Brokerage Professionals, Inc. (Media, PA) 9/08 $3,000 penalty and future license supervision for procuring surplus lines insurance and collecting premium in 2006 that netted $11,289.03 in surplus tax that was not remitted to the Pennsylvania Department of Revenue until March 2008.

Brown, Jeffrey, Sr. (Middletown, PA) 10/27/10 License revocation and five-year future license supervision – Brown failed to report numerous 2006 misdemeanor charges and the subsequent guilty pleas, failed to report his failure to file state taxes in 2003 and failed to report pending felony and misdemeanor charges.

Brown, Lorraine C. (Abington, PA) 5/2/11 Five-year license supervision – Brown failed to notify the department of a 2009 misdemeanor arrest and subsequent conviction within the required 30 days.

(Pittsburgh, PA) 11/2/10 Three-year license suspension, $4,500 penalty and $6,965.94 restitution to the Pa Department of Revenue – Burgunder failed to pay state income tax for years 2003 through 2006 and misrepresented on his license renewal applications that he was tax compliant.

Chastain, Derek Michael (Secane, PA) 6/3/10 License revocation and five-year future license supervision for submitting 114 insurance policies containing false, inaccurate and misleading information. Subsequently, the premiums for those policies were never remitted to the insurance company.

(Philadelphia, PA) 3/30/11 License revocation – On his 2010 license renewal application, Cherry failed to disclose tax liabilities and liens, two misdemeanor arrests and guilty pleas and an arrest for eight counts of forgery, eight counts of access device issues to another without authorized use, two counts of theft by deception and eight counts of theft by unlawful taking of movable property.

(Beaver Falls, PA) 3/17/11 Three-year license supervision and $800 restitution – Cox, a producer, sold two consumers an AIM and CEO Club health plan, however he failed to conduct due diligence to determine if it was a bona fide health plan. One consumer, in turn, incurred unpaid medical expenses.
