Termination and Discharge
- My employer fired me and refused to pay me the vacation time I had coming. How can I get this money?
You may file a complaint with PHRC if you believe the refusal is based on your race, sex, age, religion, national origin, disability or other protected class. However, this may be a violation of state or federal labor laws. Pennsylvania's Wage Payment and Collection Law is enforced by the Department of Labor & Industry. Find out how to file a complaint here. Federal wage payment laws are enforced by the Wage and Hour Division of the U.S. Department of Labor.

- My employer fired me, but didn't follow the discipline policy printed in the company handbook. Don't they have to do that?
It depends on the circumstances. You may file a complaint if you believe your employer did not follow the policy because of your race, sex, age, religion, national origin, disability or other protected class.

- Can they fire me for filing a complaint?
It is illegal to retaliate against someone for filing a complaint, assisting with an investigation, or otherwise opposing illegal discrimination. If you are fired because you filed a complaint with the PHRC, EEOC, HUD or other civil rights agency, you may file a retaliation complaint.
