Get information how to request information from the Department of Banking, expected response times, potential fees and the reason why many of the Department of Banking's records are not available to the public under the RTKL. Please be advised that, pursuant to Section 302.A of the Department of Banking Code (“Section 302”), 71 P.S. § 733-302.A, the Department is broadly prohibited from disclosing most of the records in its possession. Therefore, pursuant to Sections 305(a)(3), 306 and 3101.1 of the RTKL, 65 P.S. §§ 67.305(a)(3), 67.306 and 67.3101.1, most of the records in the Department’s possession are prohibited from being released to the public under the RTKL and RTKL requests for these types (or categories) of information will be denied. The OOR has upheld Department denials of RTKL requests based on Section 302. See OOR Final Determination AP 2011-0342.
Some common requests for records that the Department denies based on Section 302 (and other RTKL exceptions) are requests for mortgage licensee examination reports, bank examination reports, mortgage license applications, consumer complaints, Memorandums of Understanding regarding depository institutions, and supporting documentation to applications and orders.
Information that is publically available already appears on the Department’s website, including orders that have been issued against licensees, and the name, address and telephone numbers of licensees and institutions.
