Criminal History Background Checks Applicants/Facilities
The Older Adults Protective Services Act (OAPSA) as amended by Act 169 of 1996 and Act 13 of 1997 mandates that specific types of facilities require applicants for employment to submit their applications with a report of criminal history record information. Effective July 1, 1998, applicants and employees must be free from certain criminal convictions.
Prior to application for employment, the applicant/employee will need to obtain a criminal history record check from the Pennsylvania State Police. The request can be obtained by completing a Criminal Record Check Form (SP4-164) or by visiting the Pennsylvania State Police web site at www.psp.state.pa.us for more information.
If an applicant/employee has not been a resident of the Commonwealth of Pennsylvania for the entire 2 years (without interruption) immediately preceding the date of application for employment or currently lives out-of-state, in addition to the Pennsylvania State Police Criminal History Record Check, the applicant/employee will also need to obtain a Department of Aging FBI Criminal History Record Check.
Specific Facilities are defined under OAPSA include:
- Adult Daily Living Centers
- Assisted Living Residences
- Birth Centers
- Community Homes for Individuals with Mental Retardation
- Community Residential Rehabilitation Services
- Department of Public Welfare (DPW) Nursing Facilities
- DPW-licensed and DPW operated residential facilities for adults
- Domiciliary Care Homes
- Family Living Homes
- *Home Health Care Organization or Agency
- Intermediate Care Facilities for the Mentally Retarded (private and state)
- Long Term Care Nursing Facilities
- Long Term Structured Residences
- Personal Care Homes
- State Mental Hospitals
*Home Health Care Agency is further defined to include those agencies licensed by the Department of Health and any public or private organization which provides care to a care-dependent individual in their place of residence.
Applicants and/or employees for the specific facilities covered under OAPSA employed on/and after July 1, 1998 must satisfy conditions of the Act for employment.
