Workers’ Compensation Judges (Judges) have the power to issue subpoenas for the personal appearance of witnesses or for the production of records relevant to the proceeding at a scheduled hearing or deposition within the scope of, and scheduled under, the Judges’ Rules of Practice and Procedure. 77 P.S. Sections 833, 992.
Judges will issue subpoenas upon written request of counsel of record, or if not represented by an attorney, upon written request of a party to a workers’ compensation proceeding. The Rules require the party requesting a subpoena to serve the judge with the original written request. The Judges’ Rules at 34 Pa. Code Chapter 131, should be consulted for additional provisions related to service, objections and failure to appear.
